Any request made by an Artist, Buyer or other user shall be treated as a request for consideration and shall not automatically constitute an instruction binding upon ArtZolo.
ArtZolo does not guarantee that any Artwork, Artist profile or Program Participant will receive a specific level of visibility, promotion, enquiries, sales or commercial success. ArtZolo may determine the frequency, duration, placement and manner of promotional activities at its discretion.
11. UNAUTHORIZED REPRESENTATIONS AND COMMUNICATIONS

differences in perception of colour caused by screens or photography;
-
reasonable variations in handmade or individually created Works of Art;
-
artistic interpretation;
-
subjective assessment of quality or value;

-
investment performance; or
-
representations made by third parties without ArtZolo's express written authorization.
Any claim relating to an Artwork must be supported by reasonable evidence and submitted within the time periods specified in the applicable refund or return policy.
Nothing in these Terms prevents a Buyer or other user from raising a genuine complaint, reporting a suspected issue, exercising a statutory right or making a good-faith report to a competent authority. However, any person who knowingly makes or circulates false, misleading, defamatory or malicious statements concerning ArtZolo, its Services, Artists, Works of Art or Transactions may be subject to appropriate action by ArtZolo, including correction requests, account restrictions, suspension or termination of access and, where appropriate, legal remedies available under applicable law.

(a) completing the relevant Transaction;
(b) fulfilling delivery obligations; and
(c) legitimate ArtZolo-related communications.
Such information shall not be used for unauthorized marketing, unsolicited commercial communications or unrelated commercial purposes without appropriate consent.
17. FEES AND COMMISSIONS
ArtZolo may charge commissions, fees, service charges and/or other applicable charges in connection with the Services and Transactions facilitated through the Site. The applicable commission or fee may vary depending on the nature of the Artwork, the Artist or Program Participant, the type of Transaction, the Services provided, promotional or marketing arrangements, and other commercial considerations.
The applicable commission, fee or commercial terms for a particular Transaction shall be communicated or agreed with the relevant Artist, seller or Program Participant, as applicable, prior to or in connection with the relevant Transaction.
ArtZolo reserves the right to revise, modify or change its fee and commission structure from time to time. Any such revised fee or commission structure shall apply to future Transactions or as otherwise communicated or agreed in writing.
Applicable taxes, levies or other statutory charges on ArtZolo's fees or commissions shall be payable in addition to the applicable fees or commissions, wherever required by law.
Specific Transactions may be subject to individually negotiated or otherwise separately agreed commercial terms between ArtZolo and the relevant Artist, seller or Program Participant.
18. REMITTANCE OF SALE PROCEEDS
Subject to applicable deductions, ArtZolo shall remit amounts due to the seller within approximately thirty (30) days following:

as applicable to the relevant Transaction.
ArtZolo may deduct applicable commissions, fees, taxes, refunds, chargebacks, shipping adjustments or other amounts lawfully payable or recoverable.
19. PURCHASING ART
A Buyer may be required to register before purchasing a Work of Art.
Placing an order constitutes an intention to purchase and, subject to acceptance and applicable law, may create a binding Transaction.

Where applicable, ArtZolo may facilitate the issuance or delivery of a Certificate of Authenticity provided by the Artist or authorized seller.
Unless ArtZolo expressly provides a separate written authenticity guarantee, any representation regarding the authenticity, provenance, authorship or attribution of an Artwork originates from the relevant Artist, seller, gallery, dealer or other authorized Program Participant. ArtZolo may rely upon documentation and representations supplied by such persons and does not independently warrant or guarantee the same.
Any authenticity claim shall be governed by the documents and representations supplied by the relevant Artist, seller or authorized representative, subject to applicable law.
21. OWNERSHIP AND RISK
Unless otherwise agreed in writing, the risk associated with an Artwork shall remain with the seller until the Artwork is handed over for shipment, after which risk shall pass in accordance with the applicable shipping arrangement and applicable law.
Title to the Artwork shall pass in accordance with the terms of the relevant Transaction.
ArtZolo shall not be responsible for subsequent resale transactions or private arrangements made after the original Transaction unless ArtZolo expressly participates in such subsequent Transaction.
Any terms or commitments made by a subsequent owner or seller shall not automatically bind ArtZolo.
22. SHIPPING
Unless otherwise specified:
Express Shipping: ArtZolo aims to dispatch the Artwork within approximately four business days.
Standard Shipping: ArtZolo aims to dispatch the Artwork within approximately seven to ten business days.
These periods refer to the expected dispatch period and not necessarily the final delivery date.
Once an Artwork has been handed over to a courier or logistics provider, delivery times may be affected by factors beyond ArtZolo's control.
Such factors may include:
-
courier delays;
-
weather;
-

The Buyer must:
(a) notify ArtZolo promptly;

Original shipping charges may be non-refundable.
Return shipping costs may be borne by the Buyer unless otherwise determined by ArtZolo or required by applicable law.
